إستمرار مضايقة "ضحايا الإختطاف والإختفاء القسري" ومؤسسها

في الثاني من أكتوبر/تشرين الأول 2016، تم حظر احتجاج على مذبحة ماسبيرو، وذلك بعد أن تقدم أبرام لويس واتحاد شباب ماسبيرو بطلب ترخيص من السلطات في الجيزة لتنظيم احتجاج سلمي أمام مبنى ماسبيرو في ذكرى مذبحة المتظاهرين الأقباط التي ارتكبتها قوات الأمن في 9 أكتوبر/تشرين الأول 2011، وجاء رد السلطات بعد يومين بالرفض معللة ذلك لمسائل أمنية دون أن يتسلم المنظمون أي وثيقة رفض رسمية. وعلاوة على ذلك، أفادت التقارير عن قيام السلطات بتهديد المنظِّمين.

حول إبرام لويس

Ebram Louis إبرام لويس، هو مدافع مصري عن حقوق الإنسان، يدافع عن حقوق المرأة وحقوق الأقليات. وهو رئيس مجلس أمناء رابطة ضحايا الاختطاف والاختفاء القسري ، وهي مؤسسة غير ربحية تعمل على تقديم المساعدات القانونية والدعم المادي وغيرها من المساعدات لضحايا العنف والاعتداء والاختطاف والاختفاء القسري. كما تقوم المنظمة برصد انتهاكات حقوق الإنسان مع تركيز خاص على الفئات المهمشة والأقليات الدينية والعرقية، وعلى مكافحة التمييز ضدها. و تعمل هذه "الرابطة" منذ عام 2010.

قررت محكمة القضاء الإداري بمجلس الدولة تأجيل نظر الدعوى القضائية المقامة

في 26 مارس/اذار 2017 قررت محكمة القضاء الإداري بمجلس الدولة تأجيل نظر الدعوى القضائية المقامة من مؤسسة ضحايا الاختطاف والاختفاء القسري إلى 14 مايو/ايار 2017 مع تغريم الحكومة مبلغ 300 جنية لتعطيلها الفصل فى الدعوى بعد أن تم تأجيل عدة جلسات لاعطاء فرصة للحكومة للرد والتعقيب.

مضايقات مستمرة ضد "ضحايا الإختطاف والاختفاء القسري" ومؤسسها

تحديث: في السادس من سبتمبر/أيلول 2016، كان من المفترض أن تقرر محكمة القضاء الإداري ما إذا كان يحق لمؤسسة من ضحايا الاختفاء القسري والاختطاف  التسجيل تحت قانون الجمعيات المصري، وذلك وسط استمرار التخويف ضد مؤسسها. وقد تأجلت القضية ثانيةً إلى 26 أكتوبر/تشرين الأول 2016. 

 

في 6 سبتمبر/أيلول 2016، ستقرر محكمة القضاء الإداري ما إذا كانت ستوافق على تسجيل رابطة ضحايا الاختطاف والاختفاء القسري (FVAFD) تحت قانون الجمعيات في مصر، وذلك وسط ممارسات ترهيب مستمرة ضد مؤسسها.

"رابطة ضحايا الإختطاف والاختفاء القسري"، هي مؤسسة غير ربحية توفر المساعدات القانونية والدعم المادي وغيرها من المساعدات لضحايا العنف والاعتداء والاختطاف والاختفاء القسري. كما ترصد الرابطة أيضا انتهاكات حقوق الإنسان المرتكبة ضد الأقليات الدينية والعرقية. السيد إبرام لويس، هو مؤسس ورئيس مجلس أمناء هذه المؤسسة، يدافع عن حقوق الأقليات والمرأة في مصر.

في ديسمبر/كانون الأول عام 2014، رفضت وزارة التضامن الاجتماعي تسجيل "الرابطة" تحت قانون الجمعيات الأهلية المصري (رقم 84 لعام 2002). ولم تقدم الوزارة أي أسباب رسمية لرفض التسجيل، ولكنها صرحت بالقول أن أسباب الرفض تتعلق بـ "مخاوف أمنية". في فبراير/شباط 2015، قدمت "الرابطة" دعوى قضائية أمام محكمة القضاء الإداري للطعن في هذا القرار، وفي سبتمبر/أيلول 2015 رفضت المحكمة جلسة عاجلة لمناقشة هذه الدعوى. وقد تم إرجاء صدور القرار ثلاث مرات منذ يونيو/ حزيران 2016.

ويتزامن تأخير تسوية هذه الدعوى القضائية مع ممارسات ترهيب مستمرة ضد إبرام لويس، الذي استدعاه جهاز الأمن الوطني للتحقيق في يونيو/حزيران 2016. وقد تم استجوابه عن أنشطته الداعمة لحقوق الإنسان، ومصادر التمويل والدخل وعلاقاته مع جماعات حقوق الإنسان الدولية. كما تم تحذيره بمواجهة اتهامات خطيرة إذا لم يتوقف عن عمله في مجال حقوق الأقليات الدينية والاختفاء القسري في مصر.  في 13 أغسطس/آب 2016، عقب مشاركته في مظاهرة بوسط القاهرة تدعو لضمان حق المسيحيين في بناء وترميم كنائسهم بحرية ودون تمييز، تلقى المدافع عن حقوق الإنسان اتصالا هاتفيا من شخص عرّف نفسه بأنه ضابط بجهاز الأمن الوطني. وفي تلك المكالمة، وبخه الضابط لمشاركته في الاحتجاج وحذره من انه قد يواجه مشاكل فيما لو قام بتنظيم احتجاجات أخرى أو شارك فيها. في اليوم التالي، تم استدعاء إبرام لويس مرة أخرى للتحقيق معه، إلا أن محاميه نصحه بعدم الذهاب. 

خلال السنوات الأخيرة، تزايدت القيود المفروضة على المصريين المدافعين عن المجتمع المدني وحقوق الإنسان. ويساور فرونت لاين ديفندرز القلق في حرمان رابطة ضحايا الاختطاف والاختفاء القسري من التسجيل، ومن آثار ذلك على عمل المنظمة.

وتحث فرونت لاين ديفندرز السلطات مصرية على:

1. السماح بتسجيل رابطة ضحايا الاختطاف والاختفاء القسري، وضمان أنها قادرة على العمل بحرية دون ترهيب أو مضايقة لأعضائها؛ و

2. ضمان أن يكون جميع المدافعين عن حقوق الإنسان في مصر -وفي جميع الظروف- قادرين على القيام بعملهم المشروع في مجال حقوق الإنسان دون خوف من انتقام وبدون أي قيود.

Foundation of the Victims of Abduction and Forced Disappearance denied urgent hearing of lawsuit

On 2 September 2015 the Administrative Court of the State Council denied the Foundation of the Victims of Abduction and Forced Disappearance (FVAFD) an urgent hearing of a lawsuit, which it had filed in February 2015 against the Ministry of Social Solidarity's initial decision regarding the registration of the organisation.

FVAFD is a non-profit foundation that provides legal aid, material support and other assistance to victims of violence, assault, abduction and enforced disappearance. The organisation monitors human rights violations with a special focus on marginalised groups and religious and ethnic minorities, and combats discrimination against them. FVAFD has been operational since 2010. Mr Ebram Louis, Chairman of its Board of Trustees, is a human rights defender and advocate for Egyptian women's rights and minorities’ rights.

No legal grounds were specified for the decision to deny an urgent hearing of this lawsuit, which followed FVAFD's request to the Administrative Court of the State Council seven months previously for such a hearing, as provided for under Egyptian law. On 1 July 2015, proceedings were adjourned for two months in order for the court to decide whether to allow an urgent hearing. This appears to have been an attempt to further delay the settlement of the lawsuit and its referral to the Judicial Commissioners' Board. The decision taken on 2 September 2015 to deny the urgent hearing was not announced publicly, and the hearing of the lawsuit is scheduled to recommence on 22 November 2015.

On 14 October 2014, FVAFD submitted all the documents required for the registration of an association under Egyptian Associations Law (Law 84 of 2002) to the Ministry of Social Solidarity. The same day, Ebram Louis received confirmation that the documents had been received. Article 6 of Law 84 of 2002 stipulates that “The legal personality of the association shall be established by carrying out this registration or with the lapse of sixty days from the date the representative of the founders group submits the registration application duly fulfilled, whichever is earlier”. Since the organisation received no reply from the Ministry of Social Solidarity within the designated period, the organisation contacted the Ministry to issue the certificate of registration. However, the Ministry informed them at that stage that the request for registration had been rejected due to security concerns. The letter of rejection was dated 29 December 2014 and was not sent to Ebram Louis or any other FVAFD representative.

Front Line Defenders is gravely concerned at the restrictions imposed on Egyptian civil society, which have intensified over recent years. In July 2014, Front line Defenders produced a short documentary on the crackdown against civil society in Egypt:

Denial of registration of Foundation of the Victims of Abduction and Forced Disappearance

The Ministry of Social Solidarity has denied registration of the Foundation of the Victims of Abduction and Forced Disappearance (FVAFD) under Egyptian Associations Law (Law 84 of 2002). Although the Ministry failed to provide official reasons for denying the registration, it has verbally acknowledged that the reasons are related to “security concerns”.

We are concerned at the denial of registration of the Foundation of the Victims of Abduction and Forced Disappearance, which occurred despite the fact that the Ministry of Social Solidarity publicly warned human rights NGOs to register under Association Law No.84/2002 or be prosecuted.
