On 9 November 2016, an Israeli military court in Petah Tikva extended the interrogation period of Mr Salah Khawaja for eight additional days following the first 15 day interrogation period. Sources report that the human rights defender was blindfolded throughout the duration of the hearing and appeared physically frail and to have lost a significant amount of weight.

On 26 October 2016, Israeli forces raided the home of human rights defender Mr Salah Khawaja and arbitrarily detained him. Salah Khawaja is currently being held outside of occupied Palestinian territory - in Petah Tikva interrogation centre - without access to legal counsel.

Israeli military court extends interrogation period of Salah Khawaja

On 9 November, an Israeli military court in Petah Tikva extended the interrogation period of Mr Salah Khawaja for eight additional days following the first 15 day interrogation period. Sources report that the human rights defender was blindfolded throughout the duration of the hearing and appeared physically frail and to have lost a significant amount of weight.

Salah Khawaja is a leading member of the Stop the Wall coordination committee and is also a member of the secretariat of the Palestinian Boycott, Divestment and Sanctions National Committee (BNC). Stop the Wall is a grass roots movement uniting the peaceful struggle of the popular committees in Palestinian villages, refugee camps and cities that are impacted by the Wall and the settlements. The BNC is a coalition of Palestinian organisations that leads and supports the Boycott, Divestment and Sanctions movement.

On 9 November, Salah Khawaja was brought in front of an Israeli military court in Petah Tikva, where his interrogation period was extended for an additional eight days. The human rights defender’s lawyer, Mr Jehad Abu Raya has been denied access to his client since 26 October, day of his arrest, and was not permitted to speak with his client before, during or after the hearing. Salah Khawaja was blindfolded throughout the entire course of the hearing. Jehad Abu Raya also stated that Salah Khawaja seemed weak, sleep deprived and also appeared to have lost a significant amount of weight. The human rights defender is expected to appear before the Petah Tikva military court after the eight day interrogation period.

On 26 October, Israeli forces entered into the neighbourhood where Salah Khawaja lives and fired tear gas around his home, causing physical harm to neighbouring families, including children. Israeli forces then proceeded to raid the home of Salah Khawaja and detained him. The human rights defender was not informed of the reason for the raid or his detention.

Front Line Defenders is concerned by the apparent ill-treatment and arbitrary detention of Salah Khawaja, as it believes it to be in retaliation to his legitimate and peaceful human rights activities in the Occupied Palestinian Territory. Front Line Defenders urges Israeli authorities to ensure that the treatment of Salah Khawaja, while in detention, adheres to the conditions set out in the ‘Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment', adopted by UN General Assembly resolution 43/173 of 9 December 1988. Front Line Defenders is particularly concerned that the human rights defender has not been allowed to meet or communicate with his legal counsel since his detention on 26 October and urges Israeli authorities to allow Salah Khawaja’s lawyer and family unfettered access to him.

Salah Khawaja arbitrarily detained without access to lawyer

On 26 October, Israeli forces raided the home of human rights defender Mr Salah Khawaja and arbitrarily detained him. Salah Khawaja is currently being held outside of occupied Palestinian territory - in Petah Tikva interrogation centre - without access to legal counsel.

On 26 October 2016, at around 2.00 am, Israeli forces entered into the neighbourhood where Salah Khawaja resides in Ramallah, West Bank. According to eye witnesses, Israeli forces fired tear gas around the human rights defender’s home, causing physical harm to neighbouring families, including children. During the raid into Salah Khawaja’s home, Israeli forces conducted a search without presenting a warrant and caused some damage to their property. Following the search, Salah Khawaja was detained without being informed of the reason for the raid or his detention.

Several hours following the detention, an Israeli military judge granted a 15-day-extension of the interrogation period to the Israeli prosecution without the presence or involvement of Salah Khawaja’s legal counsel. The human rights defender’s legal counsel requested that the interrogation period in detention be reduced to 6 days but the court refused and set a new hearing for 9 November 2016. Salah Khawaja’s colleagues at Stop the Wall have expressed concern that the human rights defender may be subjected to ill-treatment. The human rights defender is being detained in the Petah Tikva interrogation centre – outside of occupied Palestinian territory, in violation of Article 49 of the Fourth Geneva Convention relative to the Protection of Civilians during Times of War, which prohibits the transfer of protected civilians to the territory of the occupying power. 

Front Line Defenders strongly condemns the raid, and arbitrary detention of human rights defender, Salah Khawaja as it believes it to be associated with his legitimate and peaceful human rights activities in the Occupied Palestinian Territory. Front Line Defenders is particularly concerned that the human rights defender has not been allowed to meet or communicate with his legal counsel since his detention on 26 October.

Front Line Defenders urges Israeli authorities to:
 

1. Immediately and unconditionally release human rights defender Salah Khawaja and cease any further judicial harassment against him;

2. Ensure that the treatment of Salah Khawaja, while in detention, adheres to the conditions set out in the ‘Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment', adopted by UN General Assembly resolution 43/173 of 9 December 1988;

3. Ensure that Salah Khawaja has access to legal counsel immediately in the case that his detention continues;

4. Guarantee in all circumstances that all human rights defenders in the Occupied Palestinian Territories are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions.
