China: Update – Human rights defender Ms Ni Yulan's fraud conviction dismissedposted on: 2012/07/31

On 27 July 2012, the Beijing First Intermediate People's Court dismissed the conviction of human rights defender Ms Ni Yulan for fraud, thus reducing her jail sentence by two months. However, the human rights defender's conviction for 'creating a disturbance' remains in place, for which she was sentenced to two years and six months' imprisonment in April 2012.

At just after 9:00 am on 10 April 2012, human rights defender and disbarred lawyer Ms Ni Yulan was sentenced to two years and eight months in prison by Xicheng District People's Court in Beijing.

Veteran human rights defender Ni Yulan and her husband Dong Jiqin are the latest victims of the Chinese government's severe crackdown on human rights defenders.

Ms Ni and Mr Dong were taken into police custody in the early hours of Thursday morning (7 April) from their small room in the Yu Xin Gong Hotel, Beijing, where they have been forced to stay for most of the last year since police demolished their home in 2008. The couple's daughter, Dong Beibei, was questioned by the police for two hours before being released. Despite numerous requests, Ms Dong was given no information regarding the whereabouts of her parents or why they are being held.

This is the latest step in a sustained and increasingly spiteful campaign by police in Beijing's Xicheng District against Ni Yulan and Dong Jiqin. Previous to this disappearance, police had forced the management of the Yu Xin Gong Hotel to cut off the electricity and water supply to their room.

Human rights defender Ms Ni Yulan faces her 19th day without electricity or internet connection due to ongoing police harassment. Her water supply has also been cut for the majority of this time.

Ni Yulan is a lawyer who has been involved in human rights defence for 11 years. She has been persistently targetted by police since offering legal aid to a Falun Gong practitioner in 1999. In 2002 Ni Yulan attempted to document on camera her neighbours' forced eviction and the demolition of their home. She was noticed by the police, and subsequently dragged to a police station and beaten so severely that she was left permanently disabled. She is currently confined to a wheelchair.

As of 7 January 2011, human rights defender Ni Yulan has had the electricity and internet connection cut for 19 consecutive days in the Beijing hotel room where she is currently staying, as a result of police pressure on the owners of the hotel. She has had only intermittent access to water during this time.
