On 20 August 2009, Mr Golden Misabiko was released on bail by the Court of Lubumbashi/Kamalondo. On 19 August the first hearing on Mr Misabiko's case took place. According to information received from members of ASADHO, the hearing was mainly devoted to formalities.

His lawyers requested that he be released on bail arguing health problems and no risk of escaping. The prosecutor replied saying that he should remain in detention because of serious evidence of his culpability. The decision was postponed to the following day.

The next hearing will take place on 26 August.
